A state appeals court says a police officer overstepped his powers, so a Kewaunee County man's drug conviction must be overturned.
The Third District court reversed Christopher Konkol's conviction for misdemeanor possession of marijuana in a 2005 police stop outside his Algoma home.
The higher court says the officer didn't have enough reason to confront Konkol before Konkol tried to get rid of some marijuana.
The panel says police need more than a mere hunch to suspect someone of a crime and the marijuana the officer recovered from Konkol was the result of an unreasonable seizure and cannot be used as evidence.
