Michigan's Attorney general has joined a case from Grand Traverse County that challenges Michigan's Medical Marijuana law.
The case from last November involves a motorist who was stopped for speeding and who is a medical marijuana user. The suspect admitted using marijuana earlier that day. A blood test later found evidence of the drug.
The state's motor vehicle code says any amount of marijuana in a driver's blood is a violation. But two courts in Grand Traverse County said that the state's Medical Marijuana law supersedes the traffic code. Judges told the prosecutor, in this case, he has to show that the amount of the drug in the suspect's system impaired his driving.
Prosecutor Al Schneider is appealing to the state Court of Appeals, and state Attorney General Bill Schuette now joins the appeal.
Schuette says if the Grand Traverse County ruling stands it puts the safety of people on the roads at risk.
