A constitutional court has recently overturned a law that equating marijuana with cocaine and heroin. The controversial law resulted in swelling prison populations. Now, the court's decision will result in at least 10,000 people being released from Italy's already overburdened prisons. The official statement from the court was that the law, passed by former Prime Minister Silvio Berlusconi in 2006, was simply, "illegitimate." Italian prisons were already operating beyond capacity. In one prominent case, Italy has seen a prison designed for 48,000 inmates, packed with 62,000.
Senator Carlo Giovanardi helped to write the now overturned law. He said the ruling was a, "devastating choice from a scientific viewpoint and in the message it sends to young people that some drugs are less dangerous than others," according to a Reuters report. Alessia Morani, an MP with the centrist Democratic Party (PD), disagrees. He explained to the Ansa news agency that, "the ruling puts the final word on one of the most absurd laws that parliament has ever passed in recent years." One year ago, the European Court of Human Rights ruled that Italy's overcrowded prisons are a violation of the basic human rights of inmates. As a result Italy was fined 100,000 euro ($131,000) and ordered it to implement changes within the year. This court ruling appears to be the first of Italy's steps in implementing those changes.
